  The CHALLENGE

       1000 IP Assets Challenge 2016 is a program launched by the Innovation and Technology Support Office (ITSO) of BatStateU to increase the number of protected Intellectual Property (IP) Assets of the University. The program will run from January 1, 2016 – December 30, 2016. BatStateU shall assist in filing your Intellectual Property for free.

  Who Can Join ???

       All BatStateU Faculty Members, Students, Alumni and Personnel who have research output (thesis, research paper or developed technology), creative works (paintings, composition, etc.) and inventions developed with support from the University.

  WHY DO I NEED TO FILE IP?

FOR AN INVENTOR, filing IP

  1. Prevents competitors from copying your technology or product
  2. Promotes innovation and creativity by providing incentive in the form of legal protection
  3. facilitate negotiations of licensing, franchising or other IP-based agreements
  4. Is essential for NBC Evaluation

FOR THE UNIVERSITY, filing IP
  1. Avoids wasteful investment in R&D and marketing
  2. Creates and enhances corporate identity
  3. Is essential for SUC Levelling, AACCUP and COD / COE Accreditation

  WHO OWNS THE LICENSE FOR GRANTED IP?

Rights to inventions/copyrights shall belong to the inventor/creator except in the instances stated in the next item. Rights to invention / copyrights shall belong to the university if any of the following circumstances exists:

  1. The invention/copyright was developed as part of the regularly-assigned duties of the inventor;
  2. The invention was supported by a specific allocation of University funds or substantial university resources other than the usual salary and resources made available to every faculty, researcher, student or staff;
  3. Commissioned works produced at the direction and control of the University in pursuit of a specific project or purpose regardless of the source of funding;
  4. In case of student as the inventor/creator, when his work was developed and he received financial support from the university in the form of scholarship (tuition fee discount), stipend, allowance or other form of assistance regardless of the amount;
  5. The work is assigned to the university such as that resulted from theses and dissertations, prototypes submitted by the students to the University in fulfillment of the academic requirements regardless of the source of funding; and
  6. In case that the invention is funded externally, wholly or partially, the University shall negotiate with the funding entity with respect to the ownership of the invention, patent rights and royalty sharing and should be stipulated in the agreement. In the absence of a negotiated agreement, the invention shall be owned by the university.

  WHAT ARE THE INCENTIVES FOR FILING IP?

The Invention Disclosure Incentive (IDI) is found in Article 11 of the BatStateU Technology Transfer Protocol. A total amount of Php50,000.00 / Php20,000.00 / Php10,000.00 will be awarded for every granted Patent/ Utility Model / Industrial Design respectively, in milestones – based tranches, to the inventor who has completed the invention disclosure process. The incentive amount shall be released following the schedule below:

  1. Php10,000.00 / Php7,000.00 / Php5,000.00 for assessed and accepted disclosure of patent / UM / ID, respectively. Result of the Formality Examination is required to claim the incentive.
  2. Php40,000.00 / Php13,000.00 / Php5,000.00 for filed patent / UM / ID, respectively. Result of the Substantive Examination is required to claim the incentive.

  DOES THE INCENTIVE APPLIES TO OTHER IP ASSET APPLICATIONS?

The incentive applies only to Inventions: Patents, Utility Models and Industrial Design.
For copyright, trademarks, etc., the university handles the logistics and shoulders the filing fee.

  WHAT SHOULD I DO TO GET THINGS GOING?

  1. Ask the Research Coordinator of your campus / college for additional information. Forms and leaflets are also available at your nearest Research Unit, Research and Management Office or the Center for Technopreneurship and Innovation. Visit www.cti.batstate-u.edu.ph for details.
  2. Check previous research output that has potential for invention application and submit pertinent documents (thesis manuscript, drawings, 10 – page summary) for patent search and evaluation.
  3. Full disclosure of invention is encouraged during patent claims drafting. To protect the inventors a Non – Disclosure Agreement will be signed among involved parties.
